Ashton Morton Slack's holiday claims experts have a great deal of experience when it comes to dealing with claims for compensation resulting from accidents, loss and injury whilst on holiday. Here is a small selection of holiday claims we have dealt with recently.

 

Car accident in Ibiza

2 clients were involved in a road traffic accident whilst on holiday in Ibiza.  They were driving along a main road and approached a cross roads at which they had right of way.  A car failed to 'give way', and collided with the side of our client's car.  The force of the impact pushed them across the road.  The Spanish police attended the scene of the accident who confirmed the Spanish driver was responsible for the accident, and confirmed his insurance details to our clients
 
It was then a relatively straightforward process in obtaining details of the UK claims handling agents in accordance with the 4th European Motor Directive in order that the claim could be pursued against the foreign driver's insurers but within the UK.

 

Moped accident in Greece 

Another client was involved in a road traffic accident whilst riding a moped on holiday in Greece.  The client was riding along a main road when without warning a car which had been travelling in the opposite direction attempted to perform a U-turn in front of them leaving our client no room to avoid a collision.  Again, because Greece has signed up to the 4th European Motor Directive, it was a simple process of contacting the Motor Insurers Information Centre in the UK to obtain the correct foreign insurer details.  Again the claim could be pursued in the UK

 

Drinks trolley accident on holiday flight

A recent case we have dealt with involved two clients on board the same aircraft.  They were sat in the seats next to the emergency exit, with no seats directly in front of them.  Without warning the food/drinks trolley suddenly toppled forwards and came down onto their knees and legs.  In view of the weight of the trolley quite unpleasant injuries were sustained.  It was difficult to establish what caused the trolley to topple, and it may well have been turbulance, however the Montreal Convention applied.
