How holiday claims work

Holiday claims don't have to be hard work. Most claims, even involving accidents abroad are run in the UK, so no foreign languages, no foreign lawyers. Most claims will succeed even if the tour operator did not actually know of the risks; you only need to show that the local business did not take proper care.

We will need as much information as possible about how the accident or injury happened, so we can tell if you have  good chance of being awarded compensation.

Building the case

Your case will be run a specialist holiday claims solicitor who will gather the evidence you need to succeed.  You might have started this process - see ‘still on holiday'.  We might ask you to see a local doctor to report on your injury.

Contacting the other party

Our holiday claim experts will write to the party responsible for your accident to give them details of your claim.  In many cases this will be the holiday company or its insurer. This letter gives them a limited amount of time to confirm whether the accident was their fault.  

Settlement

We then negotiate with the other side to agree the best compensation settlement possible for you.  We will advise you as to whether any offers made are reasonable and involve you throughout the process  The majority of holiday claims are settled without having to start a claim in court, but we are court specialists too.  If we need to, and with your agreement, we can start court proceedings.

Compensation

If you make a holiday claim under the Package Tour Regulations it means that any compensation you receive is assessed at UK levels, which is good news because foreign levels of compensation are often lower than what you can get in the UK.  So for example, even if you only have aches and pains for around a month after your accident, it's possible your holiday claim will be worth at least £1,000.00.  We can usually claim compensation for the fact that the holiday was spoilt as well.


If an injury is more severe, compensation will need to include time off work, additional medical care and even the cost of jobs at home or DIY that you could otherwise have been getting on with!
